Sorry, I'm not trying to misconstrue, I don't really understand what it is you're trying to say, especially here. That's because I'm long-winded. It takes me ten minutes to say "Yes." He means you have to be really really drunk to understand that his entire post could have been replaced witha simple "Yes". Then I need to be enlightened as to the question.

Well, to prove the point that there's never too many different ways to hear a story... My impression was that HG told Toycom to stop infringing on their license. Toycom goes to BigWest and asks "Hey, wassup wid dis?" and BigWest replies "News to us!*" and then they started probing around through the secret channels that are normally found throughout the Japanese Anime industry and find out that, yes, suddenly (for it is sudden no matter how you put a spin on it) HG IS claiming all Macross as theirs. Hence, the legal wrangling with Tatsunoko begins to determine whom had what rights to sell overseas. Menawhile, George Sohn, in his fervent desire to copy an outdated, extremely bad (see: chunky monkey) VF design leaves Toycom and starts Toynami. The company who walks hand in hand with HG. BigWest hasn't ever had a change of heart. I think you're sorely mistaken there. BigWest has consistently licensed out other Macross projects excluding the International rights to the TV Series (held by Tatsunoko and, apparently, sold to or shared with HG) with ne'er a peep from Tatsunoko or HG. And, I apologize, but HG's "excuses" for not stopping them in the past is utter horsesh!t. You know the question is: Why the change of heart by HG? They never tried to stop the licensing of other Macross projects before. Hmmm... not until Macross started regaining it's popularity here due to it's upcoming 20th anniversary. And the fact that HG suddenly "decides" that all of Macross is their's... with RT's 15th anniversary cropping up? I'm guessing that HG simply knew that with Macross' 20th anniversay, some other companies would start trying to bring over more Macross stuff to coincide with the event. Stuff that would steal the RT thunder (see: whimper). They started early by making trouble and trying to scare off companies. It worked with Toycom, because Mr. Sohn is yellow. However, HG thought they could try it again with the online retailers. Oops, no go. HG, in their refusal to prove their ownership, proved to anyone with a brain that something was rotten in Denmark. HG refused a direct challenge to their claims and, hence, basically gave permission for the retailers to sell away. Meanwhile, in the Batcave ®, BigWest and Tatsunoko are duking it out in court over who owns what (excluding the bathroom, that's communal). BTW- I've never met the Mr. Sohn, but considering the crappy knock-offs Toynami has offered, I'm believe he's more of a shrewd business man than a toy visionary. And I'm sure we can all think of many cases where business profitability far outweighs previous negative experience. *in Japanese, of course. edit-spelling The point isn't what HG failed to do in the past, the point is what they are able to enforce when they choose to enforce it. Does HG's failing to do certain things in the past have a bearing on what they can do currently? Sure. But, what that is we can only determine by what we see happening now, not in the past. I don't see this, internet business/retailers continuing to ignoring HG as that big a deal, the fact that BW can't get Macross merchandise in through anything other than the Grey Market is more telling. Did HG ignore Macross and RT for a long time? Yes. Does that mean that they give up their rights to it? No. At least not according to current evidence already mentioned. And, BW has never accused HG of mishandling the license.

When Toycom was planning on releasing the Macross Plus Valkyrie stateside, they were willing to pay both Big West and Harmony Gold in order to appease both parties. However, HG wanted the cessation of Toycom's plans and nothing less. The rest is history. If, what you're saying is true, I wonder why HG would change policies with this manga. Humm...I've gotten the impression it was the other way around. BW didn't think HG needed to be any part of it. Toycom paying HG would have to some degree substantiated the claim HG was making, that foreign releases needed to go through them. Toycom (who did read HG’s contract) says, “no prob, we’ll pay HG too.” BW says, “over our dead body.” BW threatens to pull license from Toycom and Toycom drops license cause it ain’t gonna happen with BW pitching a fit. It doesn’t make sense to me that George has such a good relationship with HG now if they were the ones to screw him in the past. I think the question is, why the change of heart by BW? I have an answer but I doubt it’s one you want to hear.

That's what I'm curious about as well. What I'm extremely worried about is, if HG has gotten their grubby little hands on M7 Trash, they might want Imaji Nariguy or Studio Yune to do the covers... ...now THAT would be a travesty. Take that back. Question: Did they release a book version of the series in Japan? If they did, I hope it's just a reprint of something like that. If not, we just might get art from Yune.

That's too bad he stopped. He should have finished it even if it was only for himself. Perhaps he could have gotten some toy company to liscense and produce it.

First off, I got of the boat from my deep sea trip to Mexico last night and the whole damn world is still moving. Ummm, you know that's not true. The TV valks are associated with the TV series and are connected with that license. The DYRL valks are associated with DYRL and are connected to the DYRL license (something HG has never been able to prove that they have the rights to), which is in limbo. If HG's claims were true, they could simply claim the license to DYRL without even having to locate whoever is the current license holder, especially since the status of the DYRL license is uncertain, they wouldn't have to fight someone for it (such as they would have to do if they ever attempted to lay claim to MacII or Mac+ from Manga). You're entirely correct on the liscense issue, they are two seperate liscneses. HG's claim is that they, at the very least, have the exclusive ability to liscense and approve merchandise for SDF Macross and it's derivatives for worldwide release. Meaning that, HG would have to pay BW to liscense everything that is liscensed outside of Japan. Unless, of course, they get liscense from BW first and then get approval from (ie. make payment to...) HG. I had thought that the reason HG couldn't make a stink about Jetfire is because Hasbro legally licensed the toy and released it under different name under a different product line (heh... kind of like what HG did to Macross). Hmmm... I think this is the real reason why HG couldn't do anything about DYRL, MacII and Mac+. Because the licenses were legally procured and HG had no reason to be involved, hence they weren't involved. Hey, were both saying the same thing. But, as you know, I don't agree that this arguement applies to the releases of DYRL?, MacII and Mac+. This is speculation, but I think the whole issue was that FASA only bought the rights from Tatsunoko to release those small Nichimo kits, but they started using the mecha designs with their gaming miniatures and also started using the images, neither of which they had the rights to. This is why they could no longer sell the miniatures and ended up redesigning those mecha. I agree, I think it's a case where they didn't get the rights through any of the proper channels. I may eat my words on this, but all I've seen is the press release from TokyoPop, which simply mentions HG's version of history with Macross, but in no way indicates any actual involvement. Also, when asked, someone at HG said that they were "cooperating". Now, "cooperating" can mean many things, including going along with things because you really have no choice (kind of what we all do when the Police bust us for Slurpee smuggling). If HG was involved with the release of Trash I'd think they'd have more exciting things to say about it. *Scene: SDCC, Toynami Booth* (Two fans talking) Fan1: Hey, did you hear the TokyoPop is releasing Macross 7 Trash? Enter George Sohn George Sohn: Really? Where'd you hear that? Fan2: The Robotech panel. Enter Alan Letz George Sohn: Alan, what's this about Macross 7 Trash. Alan Letz: Hey, if anyone wants to come to us and make a deal... (Conversation continues out of ear shot of fans.) True story. This statement is based on the assumption that HG does, in fact, hold the rights to the derivatives outside of Japan. A statement that they have not only failed to prove, but have outright refused to prove. But, to respond to your statement, I don't think BigWest HAS ever said that DYRL isn't a derivative of Macross. But it IS a different license, which Tatsunoko and, hence, HG, have never had any claim to. I agree with you, BW has never claimed that DYRL? isn't a derivative of SDF Macross and that it's a seperate liscense. A few had brought up the possibility that that could be the case. I think you know that the issue of SDF Macross has to be settled first before the derivative issue can be taken up directly. I believe it has already been settled, but you've seen my sig. I think you misinterpret HG's argument. HG can't claim rights to the designs, the Feb02 ruling made that much clear. The reason they block DYRL? valks is because they are based on a derivative of SDF Macross. BW and Yamato could very well sell the toys with a different name on them. Back in the 80's the Transformer Jetfire sold with the exact same design as a VF-1S and there wasn't a big stink about it from HG. Of course that makes FASA look like they got punked for settleing a case they might have been able to win. That is if they got the rights through the proper channels in the first place. I wouldn't call HG releasing Macross 7 Trash exactly backing off. As far as BW saying that DYRL? isn't a derivative of SDF Macross, that's a very difficult case to make. It'd be very hard to deny that the very existance of the movie was because of the popularity of the show.

It's quite possible that BW could use the designs from SDF Macross to tell a completely different story, they couldn't call it Macross, but throw a different name on it and I doubt HG could do anything about it. The thing with DYRL? is that, as you said, DYRL? itself is a derivative of SDF Macross. The movie capitalized on the success of the series.

You know my dad used to own a business a long time ago called "Blinds R Us." It wasn't very long before he got a letter from you know who. They claimed that anything named "______ R Us" infringed on their brand. They actually had no case, but the cost to dispute it in court would have put my dad out of business, he just renamed his business. But to answer the question directly, I could open a dry cleaning shop right next door to HG (thanks drew) and name it Robotech Cleaners, I could even put up pictures of generic looking mecha all over the place and HG couldn't touch me. To address the Macross issue: HG's claim stems from the fact that the subsequent shows, toys, and merchandise are derivatives of SDF Macross. Not just some random product named Macross.

Hey if Toynami can sell out their stock with an MSRP of $80 more power to them. Of course we still haven't heard a production number, I'm getting the feeling that they're going to stick with 10,000 this time. If you think they'll sell out, I sugguest you buy but, even at 10,000 its likely we'll see retailers drop their prices.

Debate threads are a lot of work for the mods. As long as they understand that and are willing to really moderate the debate then I'm all for it. If they think it takes up too much of their time and cap arguements and members because of it, it's really not a debate and not really worth it. -
HG claims a worldwide hold on SDF Macross and it's derivatives, that BW only has the right to sell merchandise within Japan. BW could produce their products where ever they'd like. Like muswp1 said, Yamato, liscensed by BW, produces in China, as does Toynami.
