HG probably bought up the licensing rights like they do with many properties for resale in international markets. IIRC, Macek said it was Matchbox or Mattel who came up with the "Robotech" line and since Matchbox (or Mattel) was using lots of designs from SDF Macross in their product line, Macek brought in HG since they already licensed Macross and RT started from there.

Concerning those people in the video cheering, most people don't really understand the situation. Many of these people are neither members of the RT or Macross communities. So what they read comes from Wikipedia or other sources. And it's only passing knowledge. Most of those people there don't understand how trademarks and copyrights work and how this pertains to Macross and RT. They just know that there is a legal situation. These people don't know that the rights have been settled for the past 5 years so any talk of the "original producers" still in litigation is not true. It is settle and has been settle for a while now. So while Tommy and HG are only addressing their side of things, these people aren't doing the research which spells out the complete situation. It stems from that many in that crowd do not quite understand how IP law works. From there, they don't understand how these things work out for RT and Macross. It would probably take a 2-hour seminar to explain to these people how intellectual property law works and then a 1-hour discussion of how this pertains to Macross and RT. I've watched some of those Youtube vids and most of the time, the question is vague enough that it can regard either trademarks or copyrights. How do we know what trademarks HG has? We looked it up. How do we know what copyrights are owned by BW? We looked it up. How do we know what BW gave up to Tatsunoko? We looked it up. How do we know how all this business with trademarks and copyrights work? We looked it up. It's all out there. All it would take is a some research. People just need to do the research. In that video, Tommy let's slip that they want to take RT international so they can't use the designs in new productions or they would run into a problem with certain property owners.

Meh. Blame the ISP if you must. ISPs take a all-or-nothing approach to copyright infringement. They remove it all or remove none. As for the no-fanart thingy, why should anyone be surprised anymore? Really....

Sorry, missed this one. I haven't seen too many involving newer works, but the older ones (1970s-1980s) seem to be where there was some legal trouble (considering the amount of time that's passed, it's no wonder). With Yamato, Yoshinobu Nishizaki is the actual creator of the series while Leiji Matsumoto's designs were what carried it forth (which is why he's mis-credited as the creator). So Nishizaki can use the name "Yamato" but can never use the artwork. For Matsumoto, he can use the artwork, but not the name, plot or characters (i.e. he can use the artwork of Susumu Kodai, but he can't call him "Susumu Kodai") from Yamato.

As stated, trademarks can last forever... at 10-year intervals. But, one must maintain the trademark in order to keep it. This is to prevent abuse and other possible misgivings to the system. (The detailed documentation can be found at the Patent and Trademark Office website) 1) You must file a Declaration of Use (or Excusable Non-use) between the 5th and 6th year from the original registration date. This ensures that the mark will be maintained during that 10-year period. 2) You must file a Declaration of Use (or Excusable Non-use) AND Application for Renewal between the 9th and 10th from the original registration date. And as my research into the matter already yielded (so don't bother asking), USA trademarks are not governed by 1st registration (BW would win that one), but by 1st usage (HG wins that one).

Actually, If you read BW's statement, it was Big West that sued Tatsunoko to verify copyright ownership.

You done? Good. Why no Vajra? Probably demand. There has to be a significant demand for a product to make it economically feasible. There has to be enough demand for it to actually be put into production. There is a market for enemy mechs, but there has to be a significant demand to actually put them into production. The VF-27 is considered the "enemy mech" and there was a demand for it, so they pushed forward on that. As for the Vajra? Maybe at a later time, but right now, I don't think there's a strong enough demand for it.

It may happen. Let's face it HG, doesn't have much of a creative unit. Most of their work focuses on 3rd party licensing (i.e., buying up international distribution rights and then selling them off elsewhere). That's probably the case. BW never came back until Macross II in 1991/92. Kawamori didn't come back till a year later and he wasn't even planning to do Plus as a Macross series. And if Tatsunoko couldn't commit to any Macross for whatever reasons, I'm sure BW asked around for who else was available (i.e. the various animation studios and Bandai). It was fairly quiet until 2003 when the whole mess started. It's not the first time a franchise goes dark because the people behind it move on to other things.
